Transparency & Explainability: Developers must document how their systems work, including limitations and failure modes. Healthcare providers need to understand what they're deploying. Clinicians need interpretable recommendations, not black-box outputs.

Clear Documentation: Who was responsible for validating the AI system for the specific clinical context? Who trained staff on its use? What protocols exist for detecting and responding to errors? These are the liability questions.
Risk Stratification: High-stakes applications like treatment planning, diagnostic confirmation, warrant different liability structures than lower-risk applications like administrative triage, data organization.
A Path Forward
An effective healthcare AI liability framework requires collaboration between developers, healthcare organizations, regulators, and the legal system. It should:
Establish clear disclosure requirements so patients and clinicians understand AI involvement in their care
Create incentives for developers to build safe, explainable systems while protecting reasonable innovation
Hold healthcare organizations accountable for responsible implementation and staff training
